Federal Fisheries Act (Fisheries and Oceans Canada, [DFO] 1985)
No matter what the activity, the Fisheries Act prohibits the killing or harming/alteration of fish populations or fish habitat (even if the habitat is only occasionally used by, or accessible to, fish throughout the year). This includes any activities that result in water withdrawals, flow diversions, bank disturbance, sediment introduction, and any activity that involves direct impacts to watercourses and waterbodies in Alberta. The standards outlined by the Fisheries Act are universal, whether your Project is a business venture or a personal endeavor, and applies to all waterbodies in Canada, even if they are entirely on private property, with a few exceptions for man-made or industrial waterbodies. Lakeland Environmental can provide regulatory support for all projects involving water in Alberta.
Provincial Water Act (Alberta Environment and Protected Areas, [AEPA] 2023)
Alberta's Water Act prohibits the alteration of natural waterbodies without approval, and limits water withdrawals from natural water sources. In addition, interaction with any fish in Alberta requires approval from AEPA, no matter the circumstance. AEPA provides Codes of Practice (COP) for certain routine activities that, if complied with, permits work within or near waterbodies in Alberta without approval under the Water Act, however, depending on the activity, input from a Qualified Aquatic Environmental Specialist (QAES) is required, and Lakeland Environmental is pleased go provide this service. We can also support with notifications to AEPA and applications for works with fish which are required for any works under a Alberta Water Act COP.
